"Soldes By Paris" competition
CONSOLIDATED STRENGTHENED RULES BY ENDORSEMENT
of December 21st, 2007

ARTICLE 1 : ORGANISER

The Paris Office du Tourisme et des Congres, (hereinafter "the Organiser") an association governed by the law of 1901, whose registered head office is located 25 rue des Pyramides, 75001 Paris, is organising a campaign entitled Soldes By Paris (hereinafter referred to as the Operation) to take place from January 9 2008 to January 20 2008 inclusive, with the aim of highlighting and drawing media attention to the winter sales in Paris in order to raise the general public's awareness of the advantages of the city at this time of year. To this end, the Organiser is organising a free competition with no purchase necessary, entitled "Jeu Soldes by Paris" to take place from December 21 2007 to January 2 2008 inclusive. It is expressly stated that no purchase is necessary for participation.

 

ARTICLE 2 : ACCESS AND DURATION

The competition will be accessible only through the Operation website in the Competition section at the following URL:www.soldesbyparistouch.com

The competition will take place from 21/12/2007 to midnight on 2/01/2008 inclusive (GMT + 2 being deemed valid). The date and time of receipt of the record of registration of the entrant on the dedicated computer server for the competition, hosted by the service provider chosen by the Organiser will be legally binding.

ARTICLE 3 : GAME FORUM

The forum of this game is the Operation website only.

ARTICLE 4 : REGISTRATION & ENTRY

4.1 This competition is open only to persons residing in Germany and England who qualify as adults in their country and who have a valid e-mail address, excluding employees of the Organiser and any company which has taken part in the organisation of the competition and their family members.

4.2 To enter the competition, entrants must, before the closing date of the competition:

log onto the website www.soldesbyparistouch.com
answer the quiz (personality test) "What kind of Parisian are you?"
complete the registration form for the prize draws on the website. Entrants must enter their name, date of birth and e-mail address.
to record their registration for the prize draws, entrants must accept the contents of the rules by ticking the relevant box.

No other form of entry (e.g. postal entries) will be taken into account.

4.3 Only one entry per person and per household is permitted (same name and address or same e-mail address or same IP address) for the entire duration of the competition. If it is found that an entrant has sent several entry forms for the same person or the same household, these will be deemed to be null and void.

The Organiser reserves the right to check that the information supplied by entrants is accurate.

Competition entries will be cancelled if they are incorrect, incomplete, forged or made in breach of these rules.

Entry to this competition and ticking the box stating acceptance of these rules on registration entails unreserved acceptance of these rules. Non-compliance with these rules will cause immediate and total disqualification from entry to the competition.


ARTICLE 5 : RESPECTING THE INTEGRITY OF THE COMPETITION

Entrants undertake not to engage or have others engage directly or indirectly in any entry procedure which is not in strict compliance with the principles of the competition and these rules.

The Organiser also reserves the right to disqualify any entrant who corrupts the workings of the competition or website or contravenes the official rules of the competition. The Organiser reserves the right to take legal action against any person attempting to perpetrate fraud or otherwise disrupt the normal progress this competition.

The Organiser reserves the right to proceed with any verification concerning compliance with the present article and all the rules, in particular with a view to disqualifying any entrant who has committed any abuse or attempted fraud in any way. The Organiser is however entitled not to proceed with systematic verification of all entries received and restrict any such verification to forms submitted by potential winners.

The Organiser reserves the right to extend, curtail, alter or cancel the present competition due to events beyond their control. If for any reason, this competition were not to function according to plan, for example due to a computer virus, bug, intervention or unauthorised external intrusion on the computing system, fraud, technical failure or any other circumstance beyond their control which corrupts or otherwise affects the management, safety, fairness or normal progress of the competition and/or the designation and status of winners, the Organiser reserves the discretionary right to cancel, alter or suspend the competition or to end it without notice, and cannot be held liable in this respect by entrants.

ARTICLE 6 : AGREEMENT ON EVIDENCE

It is agreed that the data contained in the Organiser's IT systems will constitute the definitive evidence in any dispute as to the identity data of entrants, connection to the site, entry during the competition period, any winnings and the information derived from computer processing relating to the competition organised by the Organiser.

ARTICLE 7 : DESIGNATION OF WINNERS

Two prize draws on January 3nd 2007 carried out by the bailiff holding the competition rules, will designate the 6 competition winners.

The first prize draw will designate 3 winners from among the German internet users who have answered the "What sort of Parisian would you be?" quiz and correctly filled in the entry form.
The second prize draw will designate 3 winners from among the English internet users who have answered the "What sort of Parisian would you be?" quiz and correctly filled in the entry form.

Except where prohibited by the law, the winners hereby give prior permission for their surnames, first names, town and county of residence to be used for advertising purposes on any media relating to the competition; this use will not endow them with any rights other than the right to the prize won.

 

ARTICLE 8 : PRIZES

The competition prizes are as follows:

- 3 return train trips from Germany (return train trip from a international station) to Paris, in second class, for one person, with a unitary value of 100 Euros.

- 3 return train trips from London to Paris by Eurostar, in second class, for one person, with a unitary value of £67.73, (according to the exchange rate on 07/12/2007).

All costs which are not specifically mentioned above as being included in the prize shall be borne by the winner, including but not limited to the following: putting up, travel by the winner from their place of residence to the station of their departure by train for Paris, health insurance, travel insurance and personal expenditure.

The following conditions apply to the prize:

- the departure for Paris (from either England or Germany) will take place on January 12 2008 in the morning and the return on Sunday January 13 2008 in the evening.

ARTICLE 9 : RECEIPT OF PRIZE

Winners will be informed directly of their prize by telephone or e-mail within a period of 2 days following the prize draws.

Winners will be informed of the arrangements for them to collect their prize in this e-mail.
The train tickets will be sent to winners by Chronopost by 08/01 2008 at the latest.

If winners do not reply within within 2 days of receipt of the e-mail and/or if the details are invalid, false or erroneous, the prize will be attributed to an replacement winner drawn by the bailiff.

Prizes are personal to the winner and may not be passed on to another person. Winners are not entitled to request an exchange for another prize, money or goods or a service of the same market value. Prizes are non-transferable and may not be combined with any other promotional offer.

In the event of force majeure events or other circumstances beyond their control, the Organiser may be obliged to alter the nature of the prize at stake during the course of the operation and replace it with another prize of at least equal value. This prize may on no account give rise to an exchange or refund. As a result, no claims of any nature will be replied to.

ARTICLE 10 : REFUNDS

Internet connection costs relating to entry to the competition are refunded at a fixed rate of 3 minutes of connection at the historic operator's off-peak rate, upon written request to the following address:

Limited to one entry per person for the entire competition. Each application should contain a single refund request, for a single entrant (one refund request per envelope). The corresponding postage costs will also be refunded (at the second class rate in force) on express request made at the same time as the request for refund of connection costs (which must be accompanied by the surname, first name and address of the entrant, the name of the competition, full banking details (RIB) and the itemised bill from their Internet service provider). In order to be taken into account, all requests must be made in writing and arrive within 30 days of the competition closing date, as confirmed by the postmark.

Costs relating to photocopies of proof of expenditure are refunded on request at the rate of 0.15 euro cents per sheet, if specified along with the request for refund of connection costs.

Refunds will be carried out by bank transfer, sent within 60 days of receipt of the request, after checking the legitimacy of the request and the compliance of the information in the letter requesting refund with the information recorded on the entry form submitted on the website.


Entrants who do not pay internet charges according to the number of connections they make (users with a fixed-sum subscription, cable and broadband users, etc.) are not entitled to a refund.


ARTICLE 11 : DATA PROTECTION

The personal information collected during the course of this competition is processed in compliance with the European Directive 95/46/CE on the protection of personal data. Entrants are informed that personal data recorded during the course of this competition is required for their entry to be taken into account.
All competition entrants have the right to access, alter, correct and remove their personal data. Any request must be sent to DDB Live, "Jeu Soldes By Paris", 55 rue d'Amsterdam, 75008 Paris.
This data will be used by the organising company and/or its partners for commercial use provided that the entrants have given their prior consent by ticking the relevant box on the form. It may be transferred, rented out and used by third parties. Entrants may choose to opt out of such use in a hardcopy letter posted to the aforementioned address.

ARTICLE 12 : LIABILITY

The liability of the Organiser is strictly limited to issuing prizes which have been effectively and validly won.

The Organiser may not be held liable for any malfunctioning relating to the Internet network itself or any intrusion, attempted intrusion or fraud giving rise to failure in the administration, security, fairness, integrity or management of the competition. The organiser may not be held liable for any errors, omissions, interruptions, deletions, loss of any e-mail and more generally for the loss of any data due to any such event.

The Organiser may not be held responsible for congestion on the Internet network, the quality of internet users' equipment, or the quality of their means of access which may have repercussions on the length of time taken to forward answers or the length of connection time necessary to enter the competition. The Organiser will not therefore be liable for entries where the entry forms are not recorded or are incomplete or impossible to verify.


By entering this competition and as governed by law, each entrant accepts and undertakes to take sole responsibility for guaranteeing and compensating the Organiser, its subsidiaries and parent companies, employees and local communication agencies for the present purposes, for any damage or loss caused or incurred by the entrant by entering this competition or accepting and using the prize, excluding cases provided for by applicable law.


ARTICLE 13 : LANGUAGE & DISPUTES

The rules of this game have been published in French, English and German.


In the event of disagreement as to their interpretation, the French version shall prevail.

These rules are governed by French law. Entry to this competition and ticking the box stating acceptance of these rules on registration entails unreserved acceptance of these rules. Any difficulties of interpretation of these rules and any disputes will be decided under the final authority of the organisers or the Paris tribunals (France) under French law, which has sole competency.

Costs incurred by entrants in order to obtain these rules will be refunded, at their written request enclosed with the original request, at the current second class postage rate.
